1. The Parties
The parties to the contract will be Attfield James Limited trading as Banking Advice Guide, of Cary House, South Cary Lane, Castle Cary, Somerset BA7 7ER whose registered office is Cary House, South Cary Lane, Castle Cary, Somerset, BA7 7ER ("Banking Advice Guide") and the customer as defined in the Order/Invoice Contract ("Customer").
2. The Service Product
The Service Product supplied by Banking Advice Guide is made up of individual modules of printed general banking advice based on the experience of Banking Advice Guide in helping and advising clients since 1993 with their bank negotiations to achieve front of market, cost effective banking arrangements.
Advice packs are provided without any specific knowledge of the customer’s own affairs or their current banking arrangements and issues and no warranty is given or to be implied as to the efficacy of the advice in connection with the Customer’s specific affairs. If in doubt the Customer is advised to seek professional advice on his specific affairs from Banking Advice Guide which provides a customised banking advice service at its current fee rates or from their business advisers or accountants who have specific knowledge of their business and can assist in applying the general advice in the Service Product to their specific business and banking affairs.
3. Duties and obligations of the Customer
The informationin the Service Product is copyright protected, for the Customer only and must not be reproduced to a third party or a bank without the express consent in writing from Banking Advice Guide, and any breach of this will lead to court proceedings being taken to the Customer for full damages and compensation.
Information and advice given in the Service Product modules is confidential and for the sole use of the contracting Customer. If the Customer passes this information and advice on to any other party verbally or by any other means other than reproduction who uses it to their benefit, Banking Advice Guide must be informed and will be entitled to recover fees commensurate with the Customer's contract from the other party or failing that from the Customer themselves.
4. Product price and payment
Prices charged will be based on Banking Advice Guide's current price list.
The Service Product costs are payable with order and prior to delivery of the Service Product.
The ordered Service Product will be despatched as soon as cleared funds are received which for the sake of clarity will be within 3 working days but with a target of despatch within one working day of receipt of cleared funds.
5. Confidentiality
All information received from the Customer in connection with the Contract and related matters will be treated by Banking Advice Guide in the strictest confidence and maintained within the terms of current Data Protection legislation.
6. Liability
In so far as permitted by law, Banking Advice Guide will not be liable to the Customer for any damages whether direct, incidental, special, punitive or consequential in excess of the Service Product cost due under the Contract (including but not limited to loss of income or profits).
7. Cancellation
The contract may be cancelled by the Customer providng notice of cancellation is received by Banking Advice Guide prior to despatch of the Service Product by Banking Advice Guide. Once the Service Product has left the premises of Banking Advice Guide or its despatching agent or asigns the order cannot be cancelled.
8. Governing laws
The Contract shall be governed by English Law.
